Delhi’s Rouse Avenue Court has ordered further investigation into the case against Delhi’s then Law Minister Kapil Mishra. The court ordered the Delhi Police to also question former Delhi DCP Ved Prakash Surya in this case, so that it can be known where Kapil Mishra was on February 23, 2020 and what events took place between him and Surya. This order was given on the petition filed by Mohammad Ilyas, in which an FIR was demanded against Kapil Mishra and his associates. Ilyas had alleged that Kapil Mishra and his associates had damaged the vehicles of Muslims and Dalits on Kardam Puri Road.
Court order: Further investigation against Kapil Mishra and his associates
ACJM Vaibhav Chaudhary said in his order that investigation against Kapil Mishra and his associates should be done only in relation to the first incident, as a cognizable offence is likely to be committed in it. The court also said that if this information is found to be false, then Delhi Police will have the right to take action against the complainant under section 182 of IPC (and section 217 of BNSS). The court also directed DCP North-East to send a copy of this order to the concerned police station.

Court’s comment on Kapil Mishra’s statement
The court also gave its opinion on Kapil Mishra’s statement. Mishra had said during interrogation, “I told DCP sahab that we are leaving, you open the road, otherwise we will also sit on a dharna.” The court considered this statement not just a request but an ultimatum. The court said that this statement was not a request of any kind, but a threat, and such a statement by Kapil Mishra comes under suspicious circumstances.
Who is Ved Prakash Surya?
Ved Prakash Surya is an Indian Police Service (IPS) officer and belongs to the AGMUT (Arunachal Pradesh, Goa, Mizoram and Union Territories) cadre. He joined the IPS service in 2009 and is currently serving as Superintendent of Police (SP) in the National Investigation Agency (NIA). Earlier, he was the DCP of North-East district of Delhi and was seen in a viral video with BJP leader Kapil Mishra during the 2020 Delhi riots. He was transferred from North-East district of Delhi to Rashtrapati Bhavan a year after the riots.
