Assam Chief Minister Himanta Biswa Sarma on Wednesday issued a stern warning to illegal intruders. The move comes at a time when the state cabinet on Tuesday approved the Standard Operating Procedure (SOP) under the Immigrants (Expulsion from Assam) Act, 1950. Through this SOP, the District Deputy Commissioner (DC) and Senior Superintendent of Police (SSP) will be empowered to identify illegal entrants and expel them from the state. The Chief Minister said that now there is no place for any intruder in Assam and the state government will not make any compromise in this matter.
SOP and immediate action arrangements
According to the new SOP, if any illegal intruder is caught near the zero line or within 12 hours, he will be sent back directly. Apart from this, the state government has also decided that biometric and demographic details of every intruder will be recorded. “Illegal Infiltrators Beware! The Immigrants (Expulsion from Assam) Act, 1950 is now in full force and infiltrators will be pushed out immediately,” Chief Minister Sarma said in a post on social media platform X.

10 days time and the role of the Foreigners Tribunal
Chief Minister Sarma informed that the constitutional bench of the Supreme Court has clearly stated that the Assam government has the right to use this law. Under this, the Deputy Commissioner has the right to take action by considering any suspect as a foreigner. According to the SOP, the suspect will be given 10 days so that he can present evidence of his being an Indian citizen. If after the hearing the Deputy Commissioner feels that he is a foreigner, then the process of expulsion or push back will be started immediately. At the same time, if the Deputy Commissioner is unable to reach any conclusion, then the matter will be sent to the Foreigners Tribunal.
Supreme Court’s arrangement and government’s stand
Under this law, the Supreme Court has also clarified that the state government has the right to expel foreign nationals. Chief Minister Sarma said that with the arrival of the new SOP, the process will now become more transparent and effective. The government believes that this step is very important to maintain the security and demographic balance of the state. This strict stance of the Assam government will not only help in stopping illegal infiltration but will also increase the confidence among the local citizens that the government is completely serious about protecting their safety and rights.
